- Equipment
Students who borrow equipment from Oyster Luxury Travel & Diving Ltd trading as ‘Oyster Diving’ or its instructors are responsible for covering the cost of new replacement items if the equipment is lost, damaged, or not returned in the same condition in which it was loaned (clean and dry).
Students using their own diving equipment must notify the course instructor, who will assess its suitability. All personal equipment must be fully operational and maintained according to the manufacturer’s guidelines. The student assumes full responsibility for the condition and use of their own equipment.
If you have hired a dry suit from us then we will do our best to provide you with the best fitting suit possible. Unfortunately, school dry suits will never fit as well as having one you have purchased yourself. We cannot be held responsible for leaks to dry suits.
Oyster Diving, its agents, and employees cannot be held liable for any damage to equipment or injury resulting from your negligence or other causes.
2. Travel
It is the responsibility of a student to get to/from the dive dive locations. Occasionally we may offer a customer a lift in which case Oyster Diving, its directors, and employees shall not be held liable for any damage, injury, or death resulting from travel in a company vehicle or an employee’s vehicle while conducting business for Oyster Diving.
3. Medical
All courses require a completed PADI Diving Medical Statement. The participant must answer all the questions with a ‘Yes’ or ‘No answer’. If you answer “Yes” to questions 3, 5 or 10 (marked with an *) on Side 1, or “Yes” to any questions on Side 2, then a signature from a physician on the back of the form is required to confirm the participant is fit to dive. If this is not done prior to attending the course the participant will NOT BE ABLE TO DIVE until they have received a signed medical statement as directed on the form.
A rescheduling fee of 50% of the course cost will be charged to cover the additional costs incurred of your course.

4. Booking and Rescheduling
Students acknowledge that course dates may be rescheduled if there are not enough participants. Oyster Diving is not responsible for any additional expenses incurred as a result of such changes.
To book a course or trip we require full payment in advance unless an alternative payment scheme is agreed in advance in writing. Once booked there is a 48 hour cooling off period, after which the course is non-refundable. If you need to rearrange your course we require at 5 working days notice. If more than 5 working days notice is supplied we will be happy to change the course to an alternative date but this is subject to availability.
Working days are Monday to Friday, between 9am and 5pm. Less than 5 working days notice will incur the following charges:
Tuesday nights:
7+ working days: No charge
3-6 working days: £25
<2 working days: £50
No show – rescheduling fee £95
Weekend pool:
7+ working days: No charge
3-6 working days: £25
<2 working days: £70
No show – Cost of course less 10%
Lake weekend:
7+ days: No charge
3-6 working days: £75
<2 working days: £150
No show – cost of course less 10%
Please note: All eLearning must be complete before attending any open water session. The failure to complete the eLearning beforehand will result in the diver incurring rescheduling costs.
Failure to arrive within 20 minutes of the start of your course will result in classify as a no show and you will need to reschedule.
Medical Cancellation:
<2 working days, £50 fee.
ReActivates: If <2 working days, £50
Fun divers: If <2 working days, £25
If any pre-existing medical conditions prevent you from starting your course, we will provide a full refund less a £25 administration fee, provided we receive notice and confirmation from your doctor at least four weeks before the course start date. We may require you to consult with a recommended dive doctor for additional advice or confirmation. Refunds do not apply to your booking companion if they are fit to dive, nor do they cover any equipment purchased for your course. Additionally, refunds will not be issued for study materials that have been used or redeemed. Any refunds of fees or deposits will be made solely at the discretion of Oyster Diving.
5. Publicity
Unless prior notification is given to Oyster Diving, or one of their instructors Oyster Diving may use photographs and/or videos of customers taken during the course or trip for publications, news releases, online platforms, and other communications related to the mission of Oyster Diving.
6. Cancellation, Delay, or Change Due to Unforeseen Circumstances:
In the event that a trip or activity is cancelled, delayed, or altered due to weather conditions or any other circumstances beyond the control of Oyster Diving, no liability will be accepted for any consequential damages, losses, or expenses incurred by the customer. Oyster Diving will not be responsible for costs related to accommodation, travel, or other expenses arising from the change in schedule
7. Passing Your Course
To pass a dive course you must meet all of the standards as laid out by PADI in the course requirements. Your instructor determines whether you have met the requirements and can advise that you may need to return for additional training. Additional training will be chargeable depending on the course option you have selected. Certain courses give the option of a ‘pass guarantee‘ at the time of booking. This enables you to come back as often as required to meet the course standards. The pass guarantee cannot be added once the course has started.
There is a minimum age and prerequisites for all courses, these can be found on the corresponding course pages found on the website under ‘PADI courses’. It is your responsibility to ensure you are able to meet the prerequisites!
UK Dive Trips
You must be a qualified diver of at least open water diver to attend any dive trip. You must have dived within the last 12 months, otherwise we will require you take a PADI ReActivate course before the trip, this is at an additional cost. Each diver must carry their own SMB/reel, torch, dive knife/cutting device and dive computer. You are only allowed to dive to the depth you are qualified to i.e. Open Water = 18m, Advanced Open Water = 30m, Deep Spec = 40m. To book your space we require a 50% non-refundable deposit. In the event that the trip is cancelled then you will receive a 100% refund on the cost of the boat fees, or this can be put towards the next trip. Any money for accommodation is dependent on the cancellation terms and conditions of the provider but it is in most cases unlikely to be refundable. You can still use the accommodation if you wish.
Cancellation policy: If you cancel a trip after it is booked then any payment(s) made up to that point are non-refundable. We will endeavour to our best to re-sell your space and if successful can then offer you a refund less a £25 admin fee.
